It has been brought to your notice the on going agitational programmes of our Association from 25th October 2011.  In spite of this, the Board has not taken any action in redressing our just demands.  As part of our agitational programme, we had nation wide walk out on 15th November 2011 and I am very proud to say that you have made it a hundred percent success.  I, on behalf of our Association, once again congratulate you and seek your unstinted support in our endeavour.   

On the morning of 18th Nov. 2011, Member (L & C) & South Zone, C.B.D.T, visited Bangalore on official tour.  I.T.G.O.A, protested by displaying placards highlighting our demands.  To the quick call given, majority of the members housed at Headquarters gathered and protested the visit of the Member.  Thereafter, your leaders met the Member and appraised him of the seriousness of the situation.  The Member was in full agreement with us and promised to resolve the issue as early as possible by taking the matter to the Chairman, CBDT.   Though promised no concrete steps have been taken by the Board till date.

In this connection, the Central Headquarters of I.T.G.O.A met recently and chalked out the following NATION WIDE agitational programmes:-

LUNCH HOUR DEMONSTRATIONS IN FRONT OF I.T.OFFICES
ACROSS THE COUNTRY IN ALL CCIT STATIONS AT  1-30 PM ON 30-11-2011

FROM 05-12-2011 ONWARDS:-

NON PARTICIPATION BY ALL MEMBERS OF  I.T.G.O.A. IN SEARCH & SEIZURE OPERATIONS U/s.132 & CONNECTED SURVEY ACTIONS.

ON 15-12-2011 OUR MEMBERS WILL SEND A POST CARD TO THE CHAIRMAN’S RESIDENCE – HIGHLIGHTING OUR DEMANDS.

Note: In addition to the above, the ongoing agitational programme of non submission of any type of reports, (except in case of parliamentary questions), non participation in surveys and enquiries etc. will continue.  Only time-barring work will be attended to.

In this connection, the letter written by Sri Rajesh Menon, Secretary General, ITGOA(CHQ), New Delhi, dated 19-11-2011 is annexed to this letter for your ready reference.

Retirement regards:

Sub : Intensification of Agitation for ACIT Promotion and expediting Cadre Restructuring — reg.

     This is further to Circulars dated 10/10, 30/10, 10/11 and 15/11-2011.

2. At the very outset, each and every member of ITGOA deserves full kudos for the enthusiasm and vigour exhibited in carrying out the agitation program till now.  On 18-11-2011, the ongoing agitation of ITGOA was reviewed in an Emergency  Managing Committee Meeting held at Delhi which was attended by delegates and observers from across the country, wherein it was unanimously decided that in  view of the absolute silence on the part of CBDT, the agitation must not only continue, but the same needs to be intensified further.

3. Following forms of agitation was adopted by Managing Committee of ITGOA:

Ongoing agitation to Continue with additional vigour
i. Protest demonstration before Chairman & Members of  CBDT, on  their visits.

ii. Non-cooperation like Non—submission of statistical reports, dossier reports,  DO Letters
     etc. Only Time-barring work will be attended to and artificial  deadlines like 30-11-2011
     for scrutiny will not be adhered to.

iii.  None of our members will participate in any survey action including TDS survey /
      Inspection / Verification / study or by whatever name called and Recovery Surveys
On 3O-11-2O11
Lunch Hour Demonstration in front of I.T. Offices across the country, in all CCIT stations.
From 5-12-2011 onwards
Non-participation by all members of ITGOA in Search action  u/s 132 and connected Survey actions
On 15-12-2011
Every Member of ITGOA shall send a post-card highlighting our demand, to the Chairman-CBDT at his residence.
Thereafter, the agitation will be reviewed and if need be programs like Dharna, Hunger Strike, Total Strike will be undertaken from January 2012

4. Meanwhile, an appeal has been made to the ITEF our partners in JCA to actively join the agitation, as Promotion to the grade of ACIT only can ensure consequential promotions to the staff of the IT Dept who are all members of ITEF. Besides, the Cadre Restructuring is absolutely essential for solving the pending issues like Grade Pay of Office Superintendent, recruiting more Stenos, Inspectors, Sr.TA, etc. in terms of the increased work-load. Copy of appeal is enclosed.

5. Also enclosed herewith is the letter addressed to Chairman-CBDT informing  about the decision taken in MC Meeting of ITGOA held on 18-11-2011 i.e. to continue with the ongoing agitation and to intensify the same as mentioned above, in view of the total silence and inaction on the part of the Board w. r. t our legitimate demands. All the unit leadership are requested to serve a similar notice
on the CCIT (CCA) of their respective regions.

6. Lastly, all the members of ITGOA may note that CBDT is blissfully unaware of the stagnation in the grade of ITO and the grades down-beIow and the administration is totally insensitive to our legitimate demand for timely promotions.

Hence we must be ready for a long-drawn struggle at all costs and must not rest till we succeed in getting timely promotions in all grades and better service conditions and infrastructural support for promotee officers and staff working in the IT Dept.  In this direction, following famous quotes will guide us :

Dear Comrade,

As you are aware, vide our news letter dated 14th October 2011, we have chalked out various agitational programmes commencing from 25th Oct. 2011 and it is heartening to note that most of our members are whole-heartedly participating in the programme.  However, it has come to our notice that the administration is adopting all types of tactics to extract the reports/figures from the field formations. Members are once again cautioned not to give any reports which will weaken our ongoing agitation. If members are having any difficulties or clarifications they may contact the office bearers or committee members. The Regional Presidents and Secretaries of all regions such as Hubli, Panaji, Belgaum, Davengere, Gulbarga, Mangalore and Mysore are required to report on the ongoing agitations in respect of their regions and branchs coming under them to the headquarters. We once again request all the members to kindly adhere to the call given by the Association in the larger interest of our members.
         
Though the Board has issued promotional orders for Deputy Commissioners on ad-hoc basis as Joint Commissioners, our main demand of promotion of Income Tax Officers to the grade of Assistant Commissioner is still a delusion.  No positive steps have been taken in this direction.  It is a sorry state of affairs to report that this is the only cadre in our Department, where our members have to wait for the longest period, despite being qualified and existence of vacancies. 
         
In view of the above and in continuation of the agitational programmes intimated earlier, your Association has chalked out the following programmes:-

NATIONWIDE MASS WALK – OUT ON 15/11/2011 - 2 PM

By all promottee ADDL. CsIT/JCs,IT/DCsIT/ACsIT/ITOs, AOs SPSs & PSs demanding ITO to ACIT, ACIT to DCIT PROMOTIONS to fill up hundreds of existing vacancies & for implementation of CADRE REVIEW PROPOSALS and other pending demands pertaining to AOs and PS.

 Meanwhile, we are continuing with the following agitation: Non-submission of statistical reports – CAP-I, CAP-II, DOSSIER REPORTS, D.O letters, MISMATCH REPORTS etc., Non-participation in any SURVEY action including TDS survey/ inspection/verification/study or by whatever name called including Recovery surveys.

ONLY TIME-BARRING WORK WILL BE ATTENDED TO.

PARTICIPATE TOTALLY–TO ACHIEVE OUR JUST DEMANDS.  FURTHER INTENSIFICATION OF THE AGITATIONAL PROGRAMME WOULD BE INFORMED SOON.

We should all strive hard to strengthen the Association for achieving our legitimate demands. This is a wakeup call to the Board. Press Note

The Income Tax Gazetted Officers Association (CHQ), New Delhi, the organization representing about 80% of officers of the Income Tax Department, has embarked upon an agitation programme from 25/10/2011, demanding filling up of more than 700 posts of Assistant Commissioners of Income Tax. Vacancies for the years 2010-11 and 2011-12 have not been filled up, with a delay of 17 months and 7 months respectively. The department is already facing acute shortage of manpower both at the staff and officers level, especially at the cutting edge level i.e. Assistant Commissioners of Income Tax, who are looking after the very big assessments, thus play a very crucial role in revenue collection. These vacant positions are being shared by the existing officers, by holding additional charges, which due to acute shortage of staff members results in unmanageable workload, causing disruption in tax payer service and revenue collection. The much needed cadre review & restructuring exercise to provide additional manpower, to meet growing number assesses and related assessment work, has been pending for more than two years. Considering the utter frustration of Income Tax Officers who are languishing without any promotion for around 13/14 years, despite sufficient vacancies, ITGOA informing about the proposed agitation starting from 25-10-2011, if the promotion from ITO to ACIT is not granted by that date.  As the CBDT has failed to meet the deadline, ITGOA is constrained to adopt the following mode of agitation:

a.  Boycott & protest in front of Chairman & Members-CBDT on their official visits.
b.  Non-submission of statistical reports including dossier reports.
c.  Only time-barring assessment work to be undertaken.
d.  Black-badge & Candle-light march on 03-11-2011.
e.  Non-conduct of Survey u/s.133-A including TDS Survey/Verification etc.
f.  Mass Walk-out from 2.00 PM on 15-11-2011

    The agitation will be further intensified thereafter, including strike.

ITEF (Income Tax Employees Federation) has committed their moral support for the above agitation, as the promotion from ITO to ACIT will be percolating upto the junior most official in the Department and Cadre Review & Restructuring will provide adequate staff & officers, thereby taking care of the work-load. Besides, these demands will surely boost the Revenue, which is primary for sustaining the developmental work undertaken by the Government.

Dear Comrade,

Due to unavoidable circumstances, we could not bring out our monthly news letter VIBRANT VOICE since a year or so. The Office bearers and Committee members express our sincere apologies, with a promise to rededicate their services to all the promote officers in the department.  As you are aware, the inordinate delay in decision taking by the Board, has resulted in delay in promotions to the cadre of JCs IT/ACsIT and down below the ranks. The ITGOA has requested the Board to go ahead with adhoc promotions pending decisions from the Courts, which may take some more time to finalise.

OUR MAJOR DEMANDS ARE

(a)  PROMOTION OF DCsIT TO JCsIT
(b)  PROMOTION OF ITOs TO ACsIT
(c)  DIRECTIONS TO CCIT(CCA) TO EFFECT CONSEQUENTIAL PROMOTIONS THERE UPON

The present scenario was discussed threadbare in Secretariat Meeting held on O9-10-2011 at New Delhi and it was unanimously decided that a final ultimatum be given to the Chairman, CBDT to finalise the promotions latest by 25-10-2011.  Further, as Cadre Restructuring was also pending for more than 2 Years, Board was to be asked to implement the same at the earliest.  In case of non grant of promotions by the stipulated date, ITGOA will be constrained to adopt the path of agitation* as given below:-

From 25-10-2011 onwards

     reports, DO Letters etc.

The promotion of ACsIT would result in promotions down below cadres, the ITGOA unanimously decided in the said Secretariat Meeting that ITEF, our partner in JCA, must also be invited, either to join us in the agitation or to support us in our just cause.

In the circumstances, we appeal to all our members to participate in the agitational programmes to achieve our demands.

The frustration of our members due to inordinate delay in promotions mainly ITO to ACIT has reached its pinnacle. CBDT has been apprised of our members predicament vide this office letter dated 21-9-2011 which was enclosed with the circular dated 22-O9-2011. Thereafter, during the Meeting of Chairman-CBDT with JCA held on 27-9-2011 and on follow-up meetings numbering 5, the need for timely action was highlighted to the Chairman & Member (P) by the CHQ leaders in the presence of other members.  Despite all these, there is hardly any positive development and  Board appears to be dragging its feet, without taking any decision even with respect to Ad-hoc promotion and this is a very sorry state of affairs.

The above situation was discussed threadbare in Secretariat Meeting held on 09-10-2011 at Delhi which was attended by members of 11 Units and 3 Units sending written opinion/suggestion, wherein it was unanimously decided that a final ultimatum be given to the Chairman-CBDT to finalise the promotions latest by 25-10-2011. Further, as Cadre Restructuring was also pending for more than 2 Years, Board was to be  asked to implement the same at the earliest. In case of non-grant of promotions by the stipulated date, ITGOA will be constrained to adopt the path of agitation and detailed program was also chalked-out, which is as per the letter to the Chairman-CBDT (copy enclosed).  Further, as the promotions to the grade of ACIT would percolate down, resulting in consequential promotions down below and Cadre-Restructuring  would affect all the grades of officers & staff, it was unanimously decided in the said Secretariat Meeting that ITEF our partner in JCA must also be invited, either to join us in the agitation or at least to support us in our just cause. Copy of letter to ITEF is enclosed for information.

All Units of ITGOA are required to serve a copy of the letter given to the Chairman-CBDT, on their respective CCIT (CCA) along with a notice, for carrying out the agitational program, in their regions. ITGOA (CHQ) will be pursuing the matter of inordinate delay in  promotions and implementation of Cadre Restructuring, highlighting the  huge vacancies on one hand and acute stagnation in the grade of ITO on the  other hand, with the Revenue Secretary and Hon’ble Finance Minister. 

Meanwhile, all the Units are requested to hold as many Lunch Hour  Demonstrations for apprising the members about the Board’s indifference  and ensure that the agitational program are executed with full vigour and  enthusiasm. This alone can force the nonchalant C.B.D.T, to take positive
actions to fulfill our just demand for timely promotions.

Appeal to all members, reiterated

ITGOA (CHQ) would like to reiterate its appeal as contained in our earlier circular dated 22-9-2011 i.e. ITGOA sincerely feels that all litigation  ultimately causes delay in promotion, which is self-defeating. Hence, it is our humble appeal to all members that even if litigation is essential, members
are requested to desist from bringing any stay on promotions.

2. In the Secretariat Meeting of ITGOA held today at Delhi, it was unanimously decided that a final ultimatum be served on the Chairman-CBDT for issuing  promotion of ITO to ACIT (ACIT Vacancy around 600) before 25-10-2011 and implement Cadre Restructuring at the earliest, failing which the following  agitational program will be observed :

From 25-10-2011 onwards
i. Boycott / Protest before Chairman & Members of CBDT, on their visits.
ii. Non-cooperation like Non-submission of statistical  reports, dossier
     reports, DO Letters etc.
iii. Only Time-barring work will be attended to and  artificial deadlines like

 Sub : Notice for Agitation against delay in Promotion — reg.

Please refer to the above.

2. In the Secretariat Meeting of ITGOA held today at Delhi, it was unanimously  decided that a final ultimatum be served on the Chairman-CBDT for issuing  promotion orders of ITO to ACIT, before 25"‘ October, 2011. Details of the ACIT vacancy to be filled up, is as under :

3. Besides, Cadre Restructuring which has been delayed for more than 2 years  needs to be granted at the earliest. In case of failure on the said demands i.e.  Promotions & Cadre Restructuring, we shall be constrained to observe  agitational program, as detailed here below :

From 25-10-2011 onwards
i. Boycott / Protest before Chairman & Members of CBDT, on their visits.
ii. Non-cooperation like Non-submission of statistical  reports, dossier
     reports, DO Letters etc.
iii. Only Time-barring work will be attended to and  artificial deadlines like
      30-11-2011 for scrutiny will not be adhered to.
On 3·11-2011 and thereafter
i. Black Badge day & in stations with CCIT (CCA)  Candle light march, by
   our members.
ii. None of our members will participate in any Survey action including  
    TDS Survey / Inspection/  Verification / Study or by whatever name 
    called and Recovery Surveys.
On 15-11-2011
Mass Walk-out by our members at 2 PM
The agitation will be intensified thereafter, if needed.

3. Reference may please be made to the meeting held with JCA on 27-9-2011  and regular follow-up meetings with us thereafter, the last being on 7-10-2011,  wherein we had highlighted the acute stagnation in the grade of ITO due to  inordinate delay in granting promotions to the grade of ACIT and the  adverse impact on Revenue collection efforts due to huge vacancies in the  grade of JCIT.

4. Accordingly, timely action to grant the said promotions in any case  before 25-10-2011 and to  implement Cadre Restructuring at the earliest,  is earnestly solicited, for avoiding the said unpleasant action of agitation as detailed  in para ‘3’ above, that is bound to vitiate working atmosphere and smooth functioning of office.
